EBA compliance management guidelines came into force on 1st December

Hong Kong passes amendments to AML and CTF Bill

The EBA’s Guidelines on the policies and procedures relating to compliance management, alongside the role and responsibilities of AML/CTF compliance officers, came into force on 1st December 2022.

Published in June 2022, the guidance highlights the EBA’s expectations for credit and financial institutions, including:

  • Roles and responsibilities of the firms’ supervisory and management bodies,
  • Application of the guidelines aligned with the size, nature, and scope of firms,
  • Suitability, skills, and expertise,
  • Compliance tasks and the role of the AML/CFT Compliance Officer,
  • Outsourcing and group AML/CTF structures.

Relevant firms and compliance officials should be aware of the guidelines, designed to establish a ‘common understanding’ of best practices across the industry.
