FCA Revises Enforcement Guide (ENFG)

The Financial Conduct Authority (FCA) released the final revisions to their enforcement guide (ENFG).

 

These updates follow a consultation on proposed amendments, including changes to the FCA’s investigation publicity policy.

Key takeaways from the announcement include:

➡️ In response to stakeholder feedback, the FCA has decided not to introduce a public interest framework for disclosing investigations;

➡️ The updated policy introduces three new scenarios in which the FCA may make public announcements about investigations; and

➡️ Most of the proposed amendments aimed at streamlining and clarifying the ENFG have been adopted.

✅ Despite the FCA’s decision to limit public disclosures, firms should remain vigilant and review their financial crime transformation programme priorities to ensure all control gaps are identified and closed in line with regulatory expectations.
