The arrangement forms part of the cooperation framework set out in Article 94 of the AMLA Regulation and is in line with the provisions of OLAF’s Regulation.
Key points include:
➡️ Enhanced Information Sharing: The arrangement establishes a framework for exchanging operational and strategic information, including criminal patterns, emerging trends, risk indicators and crime prevention methods;
➡️ Joint Financial Crime Analysis: OLAF can contribute its anti-fraud expertise to joint analyses coordinated by AMLA, where relevant to its mandate and subject to the consent of participating Financial Intelligence Units (FIUs);
➡️ Fraud Involving EU Funds: Cooperation will support joint operational analysis of money laundering linked to fraud involving EU funds;
➡️ Cross-Checking Intelligence: Information available through joint analyses can be cross-checked against information provided by OLAF to identify potential matches at an early stage; and
➡️ Regulatory Cooperation Framework: The arrangement supports a faster, more coordinated EU response to financial crime under Article 94 of the AMLA Regulation and in line with OLAF’s Regulation.
✅ Obliged entities, particularly those with exposure to EU-funded programmes, should monitor how cooperation between AMLA, OLAF and FIUs develops under Article 94 of the AMLA Regulation, and consider whether their risk assessments adequately reflect money laundering related to fraud involving EU funds.
